Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Temple mobile application (the "App") and the website templeai.app (the "Site"), operated by Kardia Labs LLC ("Kardia Labs," "we," "us," or "our"). Together, the App and Site are referred to as the "Service."

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you are at least 16 years old and have the legal capacity to enter into these Terms. If you are between 16 and 18, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.

We strive to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, server issues, or circumstances beyond our control. We are not liable for any loss or damage arising from Service unavailability.

3.3 Modifications

We reserve the right to modify, update, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify users of material changes.

4. Subscriptions and Payments

4.1 Free and Premium Tiers

The Service may offer both free and premium (paid) features. Access to certain features, including but not limited to AI-generated programming, advanced analytics, and unlimited history, may require an active premium subscription.

4.2 Billing

Premium subscriptions are billed through the Apple App Store. By subscribing, you agree to the pricing and payment terms presented to you at the time of purchase. Prices are subject to change, but we will notify you before any price increase takes effect on your next renewal.

4.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel at least 24 hours before the end of the current period. You can manage and cancel your subscription through your device's app store settings.

4.4 Free Trials

We may offer free trial periods. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the displayed rate. Any unused portion of a free trial is forfeited when you purchase a subscription.

4.5 Refunds

All purchases are processed by Apple. Refund requests must be directed to the App Store. We do not have the ability to issue refunds directly. Refund eligibility is subject to Apple's refund policies.

7. User-Generated Content

7.1 Your Content

You retain ownership of all content you create and post through the Service ("User Content"), including workout data, social posts, comments, photos, and workout templates. By posting User Content, you grant Kardia Labs LLC a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute your User Content solely in connection with operating and providing the Service.

7.2 Responsibility

You are solely responsible for your User Content. You represent and warrant that you have all rights necessary to post your User Content and that it does not violate any third party's rights.

7.3 Removal

We reserve the right to remove any User Content that violates these Terms or that we find objectionable, without prior notice. We are not obligated to monitor User Content but may do so at our discretion.

7.4 Workout and Template Data

Workout data, templates, and exercise logs you create are your data. You may delete them at any time through the App. If you delete your account, all associated User Content will be deleted in accordance with our Privacy Policy.

8. Intellectual Property

8.1 Our Property

The Service, including but not limited to the App, Site, AI models and outputs, exercise database, preset workout templates, user interface design, graphics, logos, trademarks ("Temple," "Samson," and the Temple logo), and all underlying software and technology, is the property of Kardia Labs LLC and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written consent.

8.2 AI-Generated Content

Workout programs, nutrition plans, exercise recommendations, and other content generated by Samson for your personal use are provided under a limited, personal, non-transferable license. You may follow and share AI-generated programs but may not commercially redistribute them, package them as your own product, or use them to train competing AI systems.

8.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us an unrestricted, irrevocable, perpetual license to use that feedback for any purpose without compensation to you.

9. Third-Party Services

The Service may integrate with or contain links to third-party services (e.g., Apple Health, social media platforms). Your use of third-party services is governed by their respective terms and privacy policies. We are not responsible for the content, accuracy, or practices of third-party services.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Without limiting the foregoing, we do not warrant that:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KARDIA LABS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law.

You agree to indemnify, defend, and hold harmless Kardia Labs LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

13.1 By You

You may terminate your account at any time by deleting it through the App settings or by contacting us. Termination does not entitle you to a refund of any prepaid subscription fees. Your subscription will remain active until the end of the current billing period.

13.2 By Us

We may suspend or terminate your account at any time, with or without cause, and with or without notice. Grounds for termination include but are not limited to: violation of these Terms, fraudulent activity, extended inactivity, or conduct that we determine is harmful to other users or the Service.

13.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including but not limited to Disclaimers, Limitation of Liability, Indemnification, and Governing Law) shall survive.

14. Dispute Resolution

14.1 Informal Resolution

Before filing any formal legal action, you agree to first contact us and attempt to resolve the dispute informally for at least 30 days. Most concerns can be resolved this way.

14.2 Binding Arbitration

If informal resolution fails, you and Kardia Labs LLC agree to resolve any disputes through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted on an individual basis, in the English language, and in the state where you reside or another mutually agreed location. The arbitrator's decision shall be final and binding.

14.3 Class Action Waiver

YOU AND KARDIA LABS LLC AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.

14.4 Exceptions

Either party may bring claims in small claims court if eligible. Either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles. To the extent that litigation is permitted under these Terms, you consent to the exclusive jurisdiction of the state and federal courts located in Florida.

We may revise these Terms at any time. If we make material changes, we will notify you by:
